AG Letitia James Again Suffers Setback In Pregnancy Center Fight

New York Attorney General Letitia James’s recent efforts to harass pro-life pregnancy centers aren’t going well for her.

Over the past year, AG James has attacked pregnancy centers that provide women with potentially lifesaving information about abortion pill reversal. Abortion pill reversal is a medical treatment that can save the life of an unborn baby whose mother has taken an abortion pill. In May, AG James sued 11 of New York’s pro-life pregnancy centers in state court, accusing them of engaging in fraud, false advertising, and deceptive business practices because they promote abortion pill reversal.

In August, two New York pro-life pregnancy centers won an preliminary injunction against AG James that protected their right to speak out about abortion pill reversal. More recently, in NIFLA v. James, two more pro-life pregnancy centers achieved a similar result; on September 24, 2024, Judge John L. Sinatra, Jr. granted a preliminary injunction in favor of plaintiffs Summit Life Outreach Center and The Evergreen Association. These two pro-life pregnancy centers had sued AG James in federal court, alleging that the Attorney General’s “targeting of pregnancy help organizations with threats and prosecution unconstitutionally chills their speech about the safety and efficacy of Abortion Pill Reversal.” Judge Sinatra’s injunction is not a final ruling, and the plaintiffs’ lawsuit will continue. Nevertheless, the injunction temporarily protects the plaintiffs from any efforts by AG James to punish them for communicating about the effectiveness of abortion pill reversal. The court’s decision also indicates that it is likely that the plaintiffs will ultimately win their case.

McGuire, Executive Director of New York Families Action, commented, “Letitia James’s unholy crusade against New York’s pro-life pregnancy centers is a misuse of her position as New York Attorney General. It also reflects her deep disregard for the freedom of speech to which every American is entitled under the First Amendment. Thankfully, Judge Sinatra has had the wisdom to rule in the plaintiffs’ favor here. Attorney General James would do well to reconsider her ideologically-motivated persecution of pro-life pregnancy centers and withdraw her lawsuit against them.”
